Before you submit a Vocu account deletion application, you should read and comply with the "Vocu Account Deletion Agreement" (hereinafter referred to as this Agreement). If you have any questions about the terms of this Agreement, please consult Vocarea. In this Agreement, whether "Vocarea" or "Vocu" (and related similar names) may be used to refer to HONGKONG VOCAREA TECHNOLOGY LIMITED and the Vocu-related services provided by HONGKONG VOCAREA TECHNOLOGY LIMITED depending on the context.
Important Reminder
Unless you have fully read, completely understood, and accepted all the terms of this Agreement, please do not initiate the Vocu account deletion process or operation. When you click "Agree" or "Next", or you start any account deletion process or operation, or express acceptance of this Agreement in any other express or implied manner, you are deemed to have read and agreed to sign this Agreement. This Agreement shall become legally effective between you and Vocarea and become a legally binding document for both parties. Please be sure to read carefully and fully understand the content of each clause, especially clauses that exempt or limit Vocarea's responsibilities, clauses that restrict your rights, and clauses that stipulate dispute resolution methods and jurisdiction (such as the relevant provisions in Article 4).
Before you agree and accept this Agreement, you should have agreed and accepted the Vocu Service Agreement and registered a Vocu account.
Vocu account deletion operation is an irreversible operation. At the same time, after account deletion, you will not be able to log in to the corresponding account to use related services. Except for relevant information or data that Vocarea should retain in accordance with relevant laws and regulations, all information, data, etc., stored and used under your deleted account will be permanently deleted. Please be cautious when performing account deletion operations.
Under your Vocu account, if there are still unused rights (hereinafter collectively referred to as: unused rights) such as unused vouchers, balances, Vocu services that have been purchased but not yet fully used, please first handle the above unused rights before submitting a deletion application. If you initiate the corresponding account deletion process when there are still unused rights under the account you are preparing to delete, it will be deemed that you voluntarily give up the corresponding rights, and the corresponding unused rights will be voided or no longer usable after you initiate the deletion process.
Since after account deletion, various consequences as shown in this Agreement will occur and may damage your rights and interests and cause you losses, please carefully read this Agreement and fully evaluate the corresponding consequences before performing account deletion related operations. At the same time, it is recommended that you make sufficient preparations in advance according to your needs before submitting an account deletion application. For example, for various data or information that you store, use, etc., in Vocu services due to using Vocu services, please complete the migration and backup of corresponding data and information or other operations before submitting a deletion application. You should bear any consequences or losses caused to you by account deletion yourself.
Account deletion does not mean that all your account behaviors and related responsibilities before the account deletion are exempted or reduced. After account deletion, you still need to bear full responsibility for all behaviors and matters under that account before you deleted the account.
If you registered a Vocu account with other accounts such as Google, WeChat, QQ, WeChat Official Account, etc., the deletion of the Vocu account will not affect your use of other corresponding services based on other accounts.
I. About This Agreement
1.1 This Agreement is a unified clause reached between the legitimate holder of the Vocu account ("You") and Vocarea regarding the Vocu account you registered in accordance with the Vocu Service Agreement before deletion.
1.2 After you submit an account deletion application to Vocarea, Vocarea will conduct corresponding checks on you and the account's related situation. Only when it is confirmed through the check that you meet the account deletion conditions can your Vocu account be successfully deleted.
II. Account Deletion Process
2.1 "Account deletion" under this Agreement refers to operations initiated by you to realize the deletion of your Vocu account and the termination of all related services you use under it, existing contracts and other relationships, and complete closure of the specific Vocu account you previously registered and legally held.
2.2 Account deletion is an irreversible operation. From the time you officially submit the application, Vocarea will verify the relevant situation of your account. If the check passes, the account will be deleted.
2.3 If you need to delete your Vocu service account, your account needs to simultaneously meet the following conditions:
(1) There are no unfinished orders or services in the account;
(2) The account has no unfinished complaints or reports, nor has it been complained or reported;
(3) There are no unused rights in the account (if you initiate the corresponding account deletion process when there are still unused rights under the account you are preparing to delete, it will be deemed that you voluntarily give up the corresponding rights, and the corresponding unused rights will be voided or no longer usable after you initiate the deletion process);
(4) You do not have any arrears or unpaid amounts;
(5) The binding relationship or external authorization between your account and other third-party network applications (such as: websites, APPs) or other accounts has been lifted, or you can be sure that not lifting such binding relationships or not withdrawing such external authorizations will not cause any adverse effects on you or any third party;
(6) All users under your account (including collaborators, sub-users, message recipients) and API keys, etc., have been deleted;
(7) All data, information, etc., that you have rights to under your Vocu account have been migrated out and properly backed up, or you completely give up the right to retain or retrieve such data;
(8) You submit an account deletion application not to evade complaints, disputes, lawsuits that are occurring or about to occur, or to evade the supervision of competent departments, or to circumvent relevant provisions of laws and regulations and other malicious intentions;
(9) The account does not have other situations where obligations should be fulfilled but have not yet been fulfilled in accordance with the requirements of laws and regulations;
(10) Other matters that may affect your rights and interests have been properly handled.
If Vocarea finds during the checking process that your account cannot simultaneously meet the above conditions, your account deletion application will be rejected. If you wish to continue deletion, you need to handle related matters according to the rejection reasons and then re-initiate the account deletion application.
2.4 During the account deletion period, if Vocarea finds that your Vocu account involves disputes or disputes, including but not limited to the possibility of involving complaints, lawsuits, arbitration, or government supervision and other matters, or the corresponding matters have already occurred, Vocarea has the right to unilaterally terminate your account deletion application without obtaining your consent again.
III. Consequences of Account Deletion
3.1 You know and agree that after the account completes the deletion process, the following consequences will occur, including but not limited to:
3.1.1 The Vocu account you previously owned will be recovered by Vocarea, and you have no right to use the original Vocu account again. You will not be able to log in to the Vocu website with that account, authorize Vocarea to access third-party network services, or use any Vocu services, etc.;
3.1.2 You will not be able to access the Vocu control panel with that account;
3.1.3 You will not be able to perform permission operations that depend on that account;
3.1.4 You will not be able to retrieve all information, data, etc., that you have stored, used, etc., under that account, except for relevant information or data that Vocarea should retain in accordance with relevant laws and regulations.
3.1.5 Other consequences that may damage your rights and interests or cause you losses.
3.2 After account deletion, any third party can initiate an application to register the account. After the account is newly registered successfully, the new account holder does not assume any responsibility for all account behaviors before account deletion.
IV. Supplementary Provisions
4.1 This Agreement is signed in the Hong Kong Special Administrative Region of the People's Republic of China.
4.2 The establishment, effectiveness, performance, interpretation, and dispute resolution of this Agreement shall apply to the laws of mainland China and Hong Kong.
4.3 This Agreement is an integral part of the Vocu Service Agreement and constitutes a unified whole with it. Vocarea has the right to modify this Agreement when necessary. You can view the latest version of this Agreement on the relevant page. Any use of this function by you is deemed to mean that you have read and agreed to this Agreement and corresponding updates.
4.4 For disputes arising from this Agreement, both parties should first resolve them through negotiation; if both parties fail to resolve them through sincere negotiation, either party should submit the dispute or dispute to the jurisdiction of the court where Vocarea is located.
4.5 The drafting and interpretation of this Agreement shall be based on Chinese. Unless otherwise agreed by both parties, any translation of this Agreement shall not serve as a basis for interpreting this Agreement or determining the intentions of both parties.
